Daniel Sarmiento: Fundamental rights as the source of European integration or disintegration?

Let us invite you to the Lord Slynn Memorial Lecture 2016, which will be held at the Faculty of Law of the Charles University in Prague (room 303) on 4 April 2016 at 4 p.m. This year, professor Daniel Sarmiento from Madrid will deliver the lecture on “Fundamental rights as the source of European integration or disintegration? From the refugees‘ crisis to the Greek referendum, with a short stop in Hungary and Poland.”

Lord Slynn Memorial Lecture is dedicated to a great person and an outstanding lawyer Lord Gordon Slynn of Hadley. This memorial is intended to promote common law, EU law and international law topics.

Daniel Sarmiento has been a professor of EU and administrative law at the Universidad Complutense in Madrid since 2010. He has also been working as a consultant on competition, administrative and EU law in the Uría Menéndez law firm. Daniel Sarmiento worked in Spain’s General State Administration (2004-2006) and at the Court of Justice of the European Union (2007-2015) alongside Advocate-Generals Dámaso Ruiz-Jarabo Colomer, Eleanor Sharpston and Pedro Cruz Villalón. Daniel Sarmiento is author of numerous academic works and collaborates with a number of prestigious international publications including Common Market Law Review, European Law Review and Revista Española de Derecho Europeo.

What will Daniel Sarmiento talk about?

Fundamental rights in the European Union have traditionally been a much cherished good. Highly demanded by lawyers, academics and, above all, citizens, fundamental rights are a basic tenet of western democratic policies in the late twentieth and early twenty-first centuries. The promise of fundamental rights in the European Union finally became a reality in 2009, when the Treaty of Lisbon gave full binding force to the Charter of Fundamental Rights.

However, the promise of fundamental rights in the European Union has proved to be a rather difficult beast to handle. Like a teenager trying to drive a Ferrari for the first time, the European Union has proved during the first years of existence of the Charter to be unable to deploy all the benefits (and challenges) of its new legal toy. The Court of Justice has struggled in pains with the horizontal provisions of the Charter as well as with individual rights, at the same time it has vetoed the European Union’s accession to the European Convention of Human Rights. The European Commission is still doubtful about how far should the Charter apply to Member States. The Council considers that the Charter does not apply when Eurozone members are in financial trouble. The European Council is happy to reach agreements with third States, openly disregarding prohibitions well ingrained in international human rights law (such as collective expulsions).

Is this just the result of a bumpy start, or is it a more telling symptom of a deeper and much serious malaise underlying the European project? This question, and some of its tentative answers, will be the subject of the 2016 Lord Slynn Memorial Lecture.

Daniel Sarmiento působí od roku 2010 jako profesor práva EU a správního práva na Universidad Complutense v Madridu. V současné chvíli je zároveň konzultantem v prestižní advokátní kanceláři Uría Menéndez, kde se specializuje na soutěžní a správní právo a právo EU. Daniel Sarmiento dříve pracoval ve španělské veřejné správě (2004-2006) a na Soudním dvoře Evropské unie (2007 – 2015) jako referendář generálních advokátů Dámase Ruize-Jaraba Colomera, Eleanor Sharpston a Pedra Cruze Villalóna. Daniel Sarmiento je autorem mnoha akademických prací a dlouhodobě spolupracuje s mnoha prestižními mezinárodními časopisy jako Common Market Law Review, European Law Review and Revista Española de Derecho Europeo.
